Terms of Service

What this service is

Tolarian Tower is a free service that lets you record a Magic: The Gathering collection and see estimated market values for the cards in it. Features may change without warning, bugs are possible, and so is data loss.

Who may use it

You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use the service only with the involvement of a parent or guardian. You are responsible for keeping your password secret and for everything done through your account.

Prices are estimates, not appraisals

The values shown are derived from public third-party price data, they may be out of date, and they may be wrong. They are not an appraisal, a valuation, an offer, a guarantee of what anyone will pay, or financial or investment advice.

Do not rely on this service for insurance, tax, estate, sale, purchase, or trade decisions, and get a professional appraisal for anything that matters. Any decision you make based on numbers you see here is yours alone.

Your data is yours

You keep ownership of the collection data you enter, and you can export it as a CSV file at any time from your account page.

So that we can actually run the service, you grant us a non-exclusive, sub-licensable, royalty-free, worldwide licence to store, copy, cache, back up, transform and display the content you put into it, and to produce the aggregate, de-identified statistics described in our Privacy Policy. This licence exists for those purposes only. It ends when you delete the content or your account, with two exceptions: copies held in backups, which end as those backups age out, and aggregate, de-identified statistics already produced from the content, which identify nobody and survive deletion.

Acceptable use

You agree not to:

• Break the law, infringe anyone's rights, or use the service to harm others.
• Attempt to gain access to accounts, data or systems that are not yours.
• Scrape, bulk-download or automate against the service in a way that degrades it for other people.
• Resell or redistribute the price data as if it were your own product.
• Interfere with, overload, or attempt to disrupt the service or its infrastructure.
• Share, sell or transfer your account, or run more than one account for yourself.

Availability

There is no uptime guarantee and no service level of any kind. The service may be slow, broken, or offline without notice, and we may change, suspend or discontinue any part of it, or the whole thing, at any time. Export your collection periodically if it matters to you.

Ending your account

You may stop using the service at any time and ask us to delete your account by writing to privacy@tolariantower.com. We may suspend or close an account that breaks these terms, or if we shut the service down. If we shut down deliberately, we will try to give you enough notice to export your collection first.

The literal and graphical information presented on this site about Magic: The Gathering, including card images, set symbols, and mana symbols, is copyright Wizards of the Coast, LLC. Tolarian Tower is not produced by or endorsed by Wizards of the Coast.

No warranty

The service is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that the data in it is accurate or complete.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost data, or losses arising from decisions made in reliance on price information shown by the service. Because the service is free, our total liability to you for any claim relating to it is limited to twenty-five Canadian dollars.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the two sections above may not apply to you. Nothing in these terms limits any right you have under consumer protection law that cannot be waived by agreement.

Changes to these terms

We may revise these terms as the service changes. The effective date at the top shows when they were last updated. For changes that materially affect your rights we will give notice by email or in the app before they take effect, and the notice will say when that is. If you do not agree to the revised terms, delete your account before the date in the notice. Continuing to use the service after that date means you accept them.

If part of these terms fails

If any provision of these terms is held to be invalid or unenforceable, that provision is to be enforced to the greatest extent permitted by law, or severed if it cannot be, and the rest of these terms remain in force. Our not enforcing a provision on one occasion is not a waiver of it.

Governing law

These terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict of laws rules. The courts of Saskatchewan will have jurisdiction over any dispute, subject to any right you have to bring a claim where you live.
